Privacy Policy

How Foodtrkr collects, uses, stores, and shares information when people use the SMS meal-logging service, dashboard, and related support channels.

This policy is a strong product-ready starting point, not a substitute for advice from your own attorney. If you launch broadly, handle regulated health data, or market in multiple jurisdictions, you should have counsel review this document and your real-world practices.

1. Scope

This Privacy Policy applies to Foodtrkr’s SMS-based calorie tracking service, dashboard, website pages, and related support communications. It explains how we handle information we collect from users, including meal descriptions, meal photos, phone numbers, support inquiries, and limited device or usage information tied to our website and dashboard.

By using Foodtrkr, you acknowledge the practices described in this policy.

2. Information We Collect

Information you provide directly

  • Your phone number and the contents of messages you send to Foodtrkr.
  • Meal descriptions, meal photos, corrections, goals, timezone responses, and dashboard requests.
  • Support, privacy, or legal communications you send to us by email or other channels.

Information generated through your use of the service

  • Calorie and macro estimates, confidence scores, timestamps, and usage history associated with your account.
  • Dashboard access tokens, session identifiers, and related security or audit logs.
  • Operational logs, request metadata, and device/browser information for website and dashboard access.

3. How We Use Information

  • Provide the Foodtrkr service, including receiving meal logs, returning estimates, and generating summaries or reports.
  • Authenticate dashboard access, maintain service security, prevent abuse, and investigate misuse.
  • Improve reliability, monitor product performance, debug issues, and understand feature usage.
  • Communicate with users about support, service changes, privacy requests, legal notices, or account events.
  • Comply with legal obligations, enforce our Terms of Service, and protect our rights, users, and systems.

4. Health-Related and Sensitive Information

Foodtrkr processes information that may relate to diet, nutrition, meal habits, and wellness. That information can be sensitive. You should avoid sending anything you do not want stored or processed to provide the service.

Foodtrkr is not intended to operate as a HIPAA-covered entity or business associate unless we expressly agree otherwise in a separate written contract. If we are subject to a health-data breach notification requirement under applicable law, including where the FTC Health Breach Notification Rule applies, we will provide notices as required by law.

Foodtrkr is not a medical provider, and the service is not designed for diagnosis, treatment, emergency response, or medical decision-making.

5. Sharing of Information

We may share information with service providers and vendors that help us operate Foodtrkr, such as SMS providers, hosting providers, analytics or logging vendors, AI model providers, and customer support tools, but only to the extent reasonably necessary for those services.

We may also disclose information:

  • To comply with legal process, law enforcement requests, or other legal obligations.
  • To enforce our agreements, investigate fraud or abuse, or protect the safety, rights, or property of Foodtrkr, users, or others.
  • As part of a merger, financing, acquisition, restructuring, or sale of assets, subject to appropriate confidentiality or legal safeguards.

We do not describe in this policy any sale of user meal logs for cash, and we do not present Foodtrkr as an advertising or data-broker service.

6. Retention

We retain information for as long as reasonably necessary to provide the service, maintain records, resolve disputes, enforce agreements, comply with law, and preserve system security. Retention periods may vary depending on the category of information and whether the information is needed for legal, operational, or abuse-prevention purposes.

If you request deletion, we will remove or de-identify information where reasonably feasible and legally permitted, but we may keep limited records needed for compliance, fraud prevention, security, backup integrity, or dispute resolution.

7. Security

We use administrative, technical, and organizational safeguards designed to protect information from unauthorized access, disclosure, misuse, alteration, or destruction. No system is perfectly secure, and we cannot guarantee absolute security.

You are responsible for protecting your own devices, message history, email inbox, and any links or credentials associated with your account.

8. Your Choices and Requests

  • You can stop scheduled outbound messages by texting STOP.
  • You can request deletion inside the product flow if that option is available, or by contacting us.
  • You can contact us to request access, correction, or deletion of certain information, subject to verification and applicable law.

Privacy requests can be sent to [email protected].

9. Children

Foodtrkr is not directed to children under 13, and we do not knowingly collect personal information from children under 13 without legally sufficient authorization. If you believe a child has provided personal information to us improperly, contact us and we will investigate.

10. International and Regional Rights

Depending on your location, you may have rights under applicable privacy laws, including rights to request access, deletion, correction, portability, or information about how your data is used. We will evaluate requests consistent with the laws that apply to us and to the request.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last updated” date and may provide additional notice where required by law.
